HOW MANY SIGNATURES ARE REQUIRED ON A POWER OF ATTORNEY FOR PERSONAL CARE?
In Ontario, a Power of Attorney for Property or a Power of Attorney for Personal Care requires an original signature by the Grantor and original signatures by two adult witnesses both of whom should not be executors, Attorneys under the Power of Attorney for Personal Care, or health care providers.
The two witnesses need to be satisfied that the person signing the Power of Attorney is capable of executing such a document.
As with a Will, all three signatures (Grantor and two witnesses) should be signed in the presence of each other. The Power of Attorney for Personal Care should indicate that this requirement has been fulfilled.
