WHY DO I NEED TO THINK CAREFULLY AND CONSULT A LAWYER ABOUT WHAT PROPERTY WILL PASS THROUGH MY WILL?

There is an important legal maxim: "Nemo dat quod non habet"  or "You can't give what you don't have".
Please consider that maxim in planning your estate. Your Executor won't be able to distribute a charitable donation, a bequest, a particular object, or a share in the estate if the item doesn't exist, you don't really own it, or there isn't enough money in the estate.

Income tax implications and probate fees are important when considering what you have and what will need to be distributed.

When a Probate Application is made to the Court you will need to have a complete Inventory of exactly what property is passing through the Will.
